Terms of Service

These Terms of Service (“Terms”) govern your use of services provided by Embers Protection Services (“EPS,” “we,” “us,” or “our”), including our website, EPS Autonomous Wildfire Defense System, and related services.
1. ACCEPTANCE OF TERMS
By using our services, accessing our website, or entering into a service agreement with EPS, you agree to be bound by these Terms. If you do not agree, do not use our services.
2. SERVICES PROVIDED
EPS provides:
• Autonomous wildfire defense systems installation and maintenance
• 24/7 real-time wildfire monitoring and threat detection
• Automated fire suppression system activation
• Property risk assessment and consultation
• Emergency notification services
• Insurance company coordination and data sharing
3. SERVICE AGREEMENT AND INSTALLATION
• All EPS system installations require a signed service agreement
• Installation timeline depends on property assessment and permit requirement
• Property access must be maintained for installation, maintenance, and emergency response
4. MONITORING AND ACTIVATION
• EPS provides continuous monitoring using satellite data, sensors, and infrared technology
• System activation is automatic based on predetermined threat levels
• Manual activation available through 24/7 customer support: 1-888-927-0901
• Customer will receive real-time alerts via text and email
5. PAYMENT TERMS
• Monthly service fees are processed automatically through Stripe
• Installation costs are due according to signed agreement terms
• All fees are non-refundable except as required by law
6. SYSTEM PERFORMANCE AND WARRANTIES
• EPS systems are U.L. Listed 508a Certified with NEMA 3R steel enclosures
• Standard warranty: 2 years from installation (extended warranties available)
• 100% success rate protecting 126+ installed properties to date
• System performance depends on adequate water supply, power, and maintenance access
7. MAINTENANCE AND SUPPORT
• Monthly maintenance included in service agreement
• Customer must provide reasonable access for maintenance and repairs
• Emergency repairs prioritized during wildfire season
• Technical support available 24/7 at 1-888-927-0901
8. CUSTOMER RESPONSIBILITIES
You agree to:
• Maintain adequate water pressure and electrical supply
• Provide safe access to EPS equipment
• Notify EPS of any system malfunctions immediately
• Keep contact information current for emergency notifications
• Comply with local fire department and emergency response protocols
9. LIMITATION OF LIABILITY
• EPS liability is limited to the total amount paid for services in the 12 months prior to any claim
• We are not liable for property damage caused by factors beyond our control (inadequate water supply, power failure, extreme weather conditions)
• EPS is not responsible for insurance coverage decisions or claim outcomes
• Force majeure events (natural disasters, government actions) may affect service delivery
10. INSURANCE AND INDEMNIFICATION
• EPS maintains $1-$2M liability insurance coverage
• Customer responsible for maintaining property insurance
• We will coordinate with insurance companies and provide system performance data
• Customer indemnifies EPS against claims arising from property access or misuse of system
11. DATA COLLECTION AND PRIVACY
• EPS collects monitoring data, property information, and personal details as described in our Privacy Policy
• Data may be shared with insurance companies and emergency services
• Customer consents to 24/7 monitoring and data collection for wildfire protection services
12. INTELLECTUAL PROPERTY
• EPS systems are protected by U.S. Patent #11247087 and other proprietary technology
• Customer receives license to use system for property protection only
• No reverse engineering, copying, or unauthorized modification permitted
13. TERMINATION
• Either party may terminate service agreement with 30-day written notice
• EPS may terminate immediately for non-payment or safety violations
• Upon termination, customer responsible for system removal costs
• Monitoring data retained for 5 years after termination
14. CALIFORNIA LAW AND JURISDICTION
• These Terms are governed by California law
• Disputes resolved in California courts
• California License #1093269
• Compliance with California Consumer Privacy Act (CCPA)
15. EMERGENCY SERVICES COORDINATION
• EPS coordinates with local fire departments and emergency responders
• Customer authorizes EPS to share property and system information during emergencies
• EPS not responsible for emergency service response times or availability
16. MODIFICATIONS
• EPS may update these Terms with 30-day notice
• Continued use of services constitutes acceptance of updated Terms
• Material changes require customer consent

18. SEVERABILITY
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
19. ENTIRE AGREEMENT
These Terms, together with your service agreement and Privacy Policy, constitute the complete agreement between you and EPS.
